The Science of Decision Enhancement

Overcoming Mindsets — Taking Control

Today's litigation arena has become increasingly complex. Judges, arbitrators, mediators and jurors often enter the decision-making process with preconceived notions (Metaprograms) that are influenced by outside sources and internal attitudes, goals, opinions, values, and core beliefs that make the decision-making process confusing and difficult. For this reason, attorneys must understand peoples' ever-changing mindsets in detail — what interests, motivates and persuades them — and how to use this information to your advantage. You can't afford to rely on assumptions and intuitions, play the percentages, and hope for the best; instead, you must take control. You and your clients will benefit significantly from the guidance of our experts in scientific decision-making research and analysis. You need an experienced Decision Navigationsm consultant to maximize the effectiveness of your case.

Decision Navigationsm:  Your Key to Success

Decision Navigationsm is the process of identifying the steps in the decision-making sequence, eliminating time-consuming roadblocks, then streamlining the remaining steps in the best sequence. Once you know the obstacles, you need to develop — through cognitive mapping — ways to enhance the decision process to increase the likelihood of your case acceptance. This is the proven way to build the strongest case and to augment your desired outcome. Decision Navigationsm — research and analysis — is a specialized field that requires the guidance, strategy skills, and analysis of a litigation psychologist.

Careful voir dire is the only protection against unfair jurors and offers a prudent alternative to "traditional" jury selection. Profile questions are designed to identify attitudes and beliefs to help identify how jurors decide the actual case issues. A TCI jury analyst is present during the voir dire process to assist the attorney with the deselection of unfavorable jurors.

Voir Dire consultation is the most efficient way to deselect the potentially worst possible jurors.

Our voir dire consultation provides a wealth of valuable and predictive information, resulting in a more receptive jury.

A SimulJurysm Proceedings Assessment Panel is a carefully selected group of jurors, similar to the actual jury in terms of their attitudes and beliefs. The panel sits in the courtroom during the trial and receives the same information as the actual jury

A SimulJurysm Panel is useful in complex or high-risk litigation, especially when it is not possible to simulate a specific part of a case. For example, a SimulJurysm can be an instrumental tool when used to observe the testimony and appearance of the opposing counsel's witnesses.

The SimulJurysm process provides an evaluation and an analysis of the ongoing reaction to the case presentation, witnesses, and evidence.

LitiPsych Procedings Assessment involves  the daily assessment of a trial as it progresses, as observed by a TCI jury analyst.

This service is recommended for those cases in which expert scrutiny of in-courtroom variables is critical to the case's outcome.

Our clients are  provided with a rich evaluation of the juror's ongoing reactions to case presentation, witnesses, evidence and problems areas.  If you would like the luxury of paying attention to the trial and the jurors at the same time, you will be impressed with the advantage that a  LitiPsych Procedings  Assessment will provide you.

Our Litigation Team is highly qualified to offer a wide variety of services to help you achieve excellence. With diverse backgrounds in psychology, sociology, persuasion, linguists and rhetoric, they bring their experience with greater confidence, expertise and passion to a variety of challenges that are unique to the legal community.

The StratSimsm Analysis is conducted to assess the case liability and damage position and to improve case strategies. This research is a series of strategic jury simulations that allows the attorney to overcome the case’s problem areas and assists in presenting the relevant issues in their most favorable light. As we conduct the jury research and examine the research data, we can determine the best approach. Research is conducted until a logarithmic function is produced. Voir dire questions are designed in the final stage of the analysis.

The primary research goal of the StratSimsm is to find a case strategy with the widest latitude of acceptance.

Jury simulations are designed to assess juror attitudes and tendencies and to enable the attorney to:

    1. Incorporate the research of the issue analysis phase
    2. Evaluate the liability position and damages awarded
    3. Refine themes, strategies, and tactics
    4. Conduct witness preparation
    5. Create winning opening and closing statements

The LitiPsymetricsm Simulation produces a report that includes quantitative analysis of surveys, results of deliberations, assessments of case strengths and weaknesses, and recommendations for improvements or changes in case strategies.

The LitiPsymetricsm Simulation scientifically assesses juror perceptions, attitudes, and core beliefs in order to produce optional strategies with zero room for error.

Demonstrative evidence, witnesses, and all case materials are tested to provide a picture of case strengths and weaknesses. This is an extended session that includes presentations by the client attorney(s) and a TCI litigation consultant.

The Paragon Panel is used to find the philosophical solutions to the intangible, abstract problems of your case.

Use the Paragon Panel after a Mini Focus Group or an Issue Analysis has identified the philosophical problems and faulty logic of surrogate jurors.

To identify the philosophical problems of case issues and to design paragon solutions.
